DMCA Policy for David Bar Lawsuit

David Bar Lawsuit is committed to respecting the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).

The DMCA provides a mechanism for copyright holders to request the removal of material that they believe infringes their rights. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the David Bar Lawsuit website or services, please notify us by submitting a "DMCA Takedown Notice" as described below.

Filing a DMCA Takedown Notice

To file an effective DMCA Takedown Notice with David Bar Lawsuit, you must provide a written communication that includes substantially the following elements, sent to our Designated Copyright Agent (see contact link below):

  1. Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work(s) that you claim have been infringed. If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
  2. Identification of the material that is claimed to be infringing: Identify the specific URL(s) or other precise location(s) on the David Bar Lawsuit website where the infringing material is located. Please provide sufficient information to allow us to locate the material.
  3. Sufficient information to permit David Bar Lawsuit to contact the complaining party: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief: Include a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: Include a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature: Provide the electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA Takedown Notice, David Bar Lawsuit will expeditiously remove or disable access to the allegedly infringing material and will take reasonable steps to notify the user who posted the material.

Filing a Counter-Notification

If you are a user of David Bar Lawsuit and believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a "DMCA Counter-Notification" to our Designated Copyright Agent. Your Counter-Notification must include substantially the following elements:

  • Identification of the material that has been removed or to which access has been disabled: Identify the specific URL(s) or other precise location(s) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number: Provide your full legal name, mailing address, and telephone number.
  • A statement that you consent to the jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which David Bar Lawsuit may be found, and that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of such person.
  • Your electronic or physical signature.

Upon receipt of a valid DMCA Counter-Notification, David Bar Lawsuit will promptly provide the complaining party with a copy of the Counter-Notification and inform them that David Bar Lawsuit may replace the removed material or cease disabling access to it in 10 business days. If the copyright owner does not file an action seeking a court order against the content provider within 10 to 14 business days after receiving the Counter-Notification, the removed material may be replaced or access to it restored.
